General Terms and Conditions of Sale RIAD LE VOILE D’ORIENT - MARRAKECH
Terms used herein that are capitalised without having been previously defined shall have the meanings set out below:
“Customer” means a natural person of legal age, acting for their own personal needs and having full legal capacity to enter into this agreement.
“Terms and Conditions of Sale for the Booked Rate” refers to the specific terms and conditions of each booking made by the Customer.
“Booking Confirmation” means the document summarising the details of the booking made by the Customer, sent to the Customer by email.
“Booking Request” means any request for a room booking made by the Customer.
“Riad” refers to Riad Le Voile d’Orient, operated by SC NEJMA, registered in the Marrakech Trade Register under number ICE 002316622000007, with its registered office at 84 Derb Laïla Chacha, Marrakech (40 000).

“Service” refers to any room booking service carried out by the Customer on the Riad’s website.
“Riad Website” refers to the website dedicated to the Riad, accessible at: https://www.riad-levoiledorient.com
Article 1 – Scope
These General Terms and Conditions of Sale apply, without restriction or reservation, to any purchase of the Riad’s room booking services and ancillary services offered by the Riad to consumers and non-professional customers (‘The Customers or the Customer’) on the Riad’s website.
The main features of the Services are presented on the Riad’s website.
The Customer is required to familiarise themselves with these before making any booking. The choice and purchase of a Service is the sole responsibility of the Customer.
The Customer declares:
• To have full legal capacity to enter into these General Terms and Conditions of Sale.
• That they are booking rooms and ancillary services for their personal use.
• That they are able to save and print these General Terms and Conditions of Sale.

Article 2 – Prices
Prices are quoted in euros, inclusive of all taxes, and invoices are issued in dirhams. All orders are payable in euros and/or Moroccan dirhams.
The Riad reserves the right to change its prices at any time, but the product will be invoiced on the basis of the rate in force at the time the order is confirmed and subject to availability.
The price paid covers the rental for the duration specified at the time of booking one or more rooms at the Riad.
Rates do not include the tourist tax of €2.50 per day per person, payable directly on site at the Riad (children up to the age of 10 are exempt from tourist tax).
The Customer undertakes to pay these various taxes to the Riad without any objection.
The payment requested from the Customer corresponds to the total amount of the booking, excluding this tax.
A Moroccan breakfast is included in the price.
Invoices are issued in Moroccan dirhams. The exchange rate applied is calculated based on the current rate.
Article 3 – Booking
Guests can make a booking 24/7 via the Riad’s website: https://www.riad-levoiledorient.com
The Guest selects the services they wish to book on the Riad’s website (booking form) in accordance with the following terms:
• Selecting the room type and rate
• Specify the desired dates
• Entering their contact details
• Review and acceptance of the general terms and conditions of sale and the terms of the selected rate prior to confirming the booking
• Once the Riad has checked availability for the desired dates and confirmed that a booking can be made, the sale of Services shall only be considered final upon receipt of payment by bank transfer of a deposit of 30% of the total cost of the stay (transfer fees are payable by the Customer) and the Riad’s sending of confirmation of the booking’s acceptance to the Customer by email.
The Customer acknowledges that they have taken note of the nature, destination and booking terms of the Services offered by the Riad and that they have sought and obtained the necessary information to make their booking in full knowledge of the facts. They are solely responsible for their choice of services and their suitability to their needs, such that the Riad cannot be held liable in this regard.
The Customer undertakes to provide the necessary information on the booking request and certifies the truthfulness and accuracy of the information provided.
Any booking made and confirmed by the Riad constitutes the formation of a distance contract between the Customer and the Riad.
The Riad reserves the right to cancel or refuse any booking from a Guest with whom there is an outstanding dispute regarding payment for a previous booking.
Each booking is made in a specific name and may under no circumstances be transferred to a third party.
Cancellation terms:
Cancellation of a booking between 14 days and the start of the stay:
In the event of cancellation of the booking by the Guest after its acceptance by the Riad 14 days prior to the scheduled date of stay, for any reason whatsoever, the 30% deposit will not be refunded.
Cancellation of a booking between 8 and 14 days before the stay:
If the Customer cancels the booking after it has been accepted by Le Riad between 8 and 14 days before the scheduled date of stay, for any reason whatsoever, 50% of the total amount will remain payable.
Cancellation of a booking less than 8 days before the stay:
In the event of cancellation of the booking by the Customer, for any reason whatsoever, less than 8 days before the stay, the sum corresponding to 100% of the total amount will be charged to the Customer. The same shall apply in the event of the Customer’s failure to arrive on the scheduled date of arrival.
Article 4 – Confirmation of the booking
Any request made via the website: https://www.riad-levoiledorient.com
implies the Customer’s acceptance of these General Terms and Conditions of Sale.
Any order confirmation implies the Customer’s full and unconditional acceptance of these General Terms and Conditions of Sale, without exception or reservation.
All data provided and the recorded confirmation shall constitute proof of the transaction.
The Customer declares that they are fully aware of this.
The order confirmation shall constitute a signature and acceptance of the transactions carried out.
A summary of the order details and these General Terms and Conditions will be sent to the email address provided for order confirmation.
Article 5 – Payment
By confirming the order, the Customer undertakes to pay the price indicated.
Payment for purchases shall be made:
• By bank transfer in euros for the 30% deposit (bank charges associated with this transaction are payable by the customer)
• The balance of the invoice is to be paid at the end of the stay either by credit card or in cash (Euros or Dirhams)
Article 6 – Availability
Our rooms are listed on the website: https://www.riad-levoiledorient.com and are subject to availability on the date of booking and for the desired period.
Article 7 – Services
The services booked by the Customer, which include the booking of rooms at the Riad and any additional services, will be provided in accordance with the following terms and conditions, as set out in these General Terms and Conditions of Sale, which the Customer has read and accepted when making their booking on the Riad’s website.
On arrival, those who made the booking will be asked to present their ID in order to complete the mandatory police registration form.
The Riad is a non-smoking establishment, with the exception of the terrace. The Customer shall be held liable for any direct and/or indirect, consequential damage resulting from smoking within the Riad. They shall therefore be liable for the full cost of cleaning and restoring the damaged item or area to its original condition.
The Guest is solely responsible for any personal belongings left in the Riad room or in the Riad’s public areas. The Riad cannot be held liable for any loss, theft, deterioration or damage caused to such belongings.
The Guest agrees and undertakes to use the room under normal conditions of use. Furthermore, any behaviour contrary to public decency and public order will result in the Riad asking the Guest to leave the premises without any compensation and/or without any refund if payment has already been made. In the event that no payment has yet been made, the guest must settle the cost of the nights stayed before leaving the establishment.
In accordance with current legislation, please note that the consumption of alcohol is prohibited within the Riad.
The Guest shall be held liable for all direct and/or indirect consequential damages caused by them, observed in the reserved room or which they may cause within the Riad. Consequently, they undertake to compensate the Riad for the full amount of such damage, without prejudice to any damages that may be due, or legal and solicitors’ fees incurred by the Riad.
Free Wi-Fi (fibre) access enabling guests to connect to the internet is provided in accordance with the Riad’s current policy.
Unless otherwise expressly stated, the room will be made available to the Guest on the day of arrival at 2 pm and the Guest shall vacate the room on the day of departure by 12 noon. Failing this, an additional night’s stay will be charged to the Guest. The Guest must check their departure date. In the event of early departure, a charge equivalent to one night’s stay will be applied, unless the Guest has notified the Riad at least 24 hours prior to departure.
However, the Guest may check in outside these times.
The Guest shall have a period of 8 days from their date of departure from the Riad to submit, in writing, any reservations or complaints regarding the provision of the Services, together with all relevant supporting documents, to the Riad.
No complaint may be validly accepted if the Guest fails to comply with these formalities and deadlines.
In the absence of any reservations or complaints expressly raised by the Guest within this timeframe upon receipt of the Services, the Services shall be deemed to comply with the booking in terms of quantity and quality.
In the event of relocation:
In the event of exceptional circumstances, force majeure or the inability to make the reserved room available to the Guest, the Riad reserves the right to accommodate the Guest, in whole or in part, in a Riad of an equivalent category, for services of a similar nature and subject to the Guest’s prior consent.
Article 8 – Place of service provision.
Rooms are offered at Riad Le Voile d’Orient, located at 84 Derb Laïla Chacha, within the Medina of Marrakech (40 000).
Article 9 – Guarantee
The Service Provider guarantees the Customer, in accordance with legal provisions and without additional payment, against any lack of conformity or hidden defect arising from a failure to perform the Services booked and actually paid for under the terms and conditions set out in these General Terms and Conditions of Sale.
The Services provided via the Riad’s website comply with the regulations in force in Morocco. The Riad shall not be held liable in the event of non-compliance with the legislation of the country in which the Services are provided; it is the Client’s responsibility, as the sole party responsible for the choice of Services requested, to verify this.
Article 10 – Liability
The Rooms offered and, in the case of a rental of the entire Riad, comply with current Moroccan legislation. The Riad cannot be held liable in the event of non-compliance with the legislation of its customers’ country of origin. Only Moroccan legislation shall apply.
Furthermore, the Riad cannot be held liable for any damage resulting from the misuse of a room or the communal areas made available.
Finally, the Riad cannot be held liable for any inconvenience or damage inherent in the use of the internet, in particular service disruption, external intrusion or the presence of computer viruses.
Guests undertake to return the room in the same working condition as they found it on arrival. All items, accessories, linen, equipment, decorations, etc. present in the room and/or in the communal areas upon the Guests’ arrival remain the exclusive property of the Riad. Any item that goes missing from the Room occupied by the Guests will automatically be charged at the purchase price. Unless the Guest returns the missing items, they unconditionally agree that the amount will be debited from their credit card.
Article 11 – Applicable law in the event of disputes
The language of this contract is French, one of the three official languages of Morocco. These terms and conditions of sale are subject to Moroccan law. In the event of a dispute, the Moroccan courts shall have exclusive jurisdiction.
Article 12 – Intellectual property
All elements of the website https://www.riad-levoiledorient.com are and remain the exclusive intellectual property of the Riad. No one is authorised to reproduce, exploit, redistribute or use for any purpose whatsoever, even partially, any elements of the website, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the written consent of the Riad.
Article 13 – Personal Data
The Riad reserves the right to collect personal information and personal data concerning its customers. This information is necessary for the management of orders, as well as for improving the services and information we send to you.
It may also be passed on to companies involved in these dealings, such as those responsible for the fulfilment of services and orders for their management, execution, processing and payment.
This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations.
Article 14 – Pre-contractual information – Customer acceptance
The Customer acknowledges having been provided, prior to making their booking and concluding the contract, in a legible and comprehensible manner, with these General Terms and Conditions of Sale, in particular the following information:
• The essential characteristics of the Services, taking into account the means of communication used and the Service concerned;
• The price of the Services and any associated costs;
• Where the contract is not to be performed immediately, the date or timeframe by which the Service Provider undertakes to provide the Services booked;
• Information regarding the Service Provider’s identity, postal, telephone and email contact details, and activities;
• Information regarding statutory and contractual guarantees and the terms and conditions for their implementation;
• The features of the digital content;
• The possibility of resorting to contractual mediation in the event of a dispute;
• Information regarding important contractual terms and conditions.
• Accepted methods of payment.
The fact that a natural person (or legal entity) makes a booking on the Riad’s website implies full and unconditional acceptance of these General Terms and Conditions of Sale and an obligation to pay for the Services ordered, which is expressly acknowledged by the Customer, who waives, in particular, the right to rely on any conflicting document that would be unenforceable against the Service Provider.
